It was raining this morning and I am late for work.
Ok, I wasn't late because it was raining. I was late because I slept in.
I slept in because it was raining.
Now we all know how difficult it is to get out of bed when it rains. In fact, rain makes slumbering so gratifying that waking up is impassable. This is one of God's blessing to us humankind when He made the rain.
Therefore the act of my sleeping-in is accordance with the laws of nature controlled by a 'greater force', the french term would be 'force majeur'.
In most contracts (employment contracts including), force majeur clauses would free a party from performing its obligation when an extraodinary event beyond the control of the party occurs, such as war, strike, riot or an act of God.
So technically speaking....
My failure to be at work on time today is wholly justified, defended and covered under the force majeur provision in my employment contract.
In fact, if I fall asleep at my desk right now (as it is still raining), my boss should reconsider throwing that staple at my direction if he does not want to hear from my Union.
